In 2017, the Russian authorities adopted Decree No. 961, which regulates the process of providing financial assistance to borrowers who find themselves in a difficult life situation. The government allocated about 2 billion rubles for these purposes. In order to become a member of the AHML mortgage program at Sberbank, a person must come to a credit institution and write an application.

Budget benefits are provided to the following persons:

  • Citizens who have one or more dependent children (including adopted children);
  • Veterans of military conflicts;
  • Parents who have a dependent student under the age of twenty-four studying full-time;
  • Disabled people and citizens caring for people with disabilities.

Assistance is provided to families who find themselves in a difficult financial situation (household income does not exceed twice the living wage in the last 90 days). The second mandatory condition for granting subventions is an increase in the cost of borrowed funds by thirty percent or more.

The terms of the AHML mortgage program at Sberbank impose certain restrictions on the area of ​​collateral. The maximum size of a one-room apartment cannot be more than 45 sq. meters. Two-room apartment - 65 sq. m. Three-room - 85 sq. m. Benefits are due to citizens for whom a mortgage apartment is the only housing. You can apply for a grant 12 months after signing the loan agreement.

To participate in the AHML Mortgage Program at Sberbank, the applicant must prepare:

  • Statement;
  • Passport of a citizen of the Russian Federation;
  • Birth certificate of all children;
  • Adoption certificate, permission from the guardianship authorities and a court decision (if there are adopted children);
  • War veteran's certificate;
  • Certificate of medical examination. This paper is presented in the presence of disability;
  • A document from the university (for a full-time student);
  • Statement of an individual pension account;
  • Certificate of income in the form of a credit institution;
  • Employment book, certified by the seal and signature of the director of the company;
  • Certificate from the employment center on the amount of unemployment benefits (for temporarily unemployed citizens);
  • A report on the valuation of collateral real estate, drawn up at the time of issuance of a housing loan;
  • Original loan agreement;
  • Copy of registration sheet;
  • Payment schedule.

According to the terms of the AHML mortgage program at Sberbank, the applicant must present an insurance contract and a receipt confirming the payment of the insurance premium. The list of securities can be changed at the request of Sberbank managers. If the lender approves the restructuring, the balance of the debt will be reduced by 30% (the maximum amount of compensation is 1.5 million rubles).

Accrued fines and penalties will be written off (except for penalties that the borrower had to pay on the basis of a court decision). If the loan was issued in a foreign currency, then its amount must be recalculated at a special rate (it must be lower than the official currency quotes). The marginal cost of a foreign currency loan is set at 11.5% per annum.

Experts of the Accounts Chamber believe that the program of assistance to foreign currency borrowers has serious shortcomings. Officials believe that the conditions for providing financial assistance are not transparent enough. The consequence of this is a large percentage of refusals to grant budget benefits. The program is designed mainly for foreign currency borrowers. Clients who have taken a loan in rubles have practically no chance of receiving subsidies.

Banks are extremely reluctant to renegotiate contracts. They in every possible way delay the process of considering applications for the AHML mortgage program at Sberbank and refuse to provide preferential terms to most applicants. Bankers do not want to worsen the quality of the loan portfolio, as this will require the creation of additional financial reserves.

Employees of the Accounts Chamber believe that the number of restructured mortgage loans is underestimated, which indicates the misuse of budget funds (according to official data, about 1,300 contracts were revised). This problem was described in a letter sent to AHML. The answer to the request of the Accounts Chamber has not yet followed.

The attitude towards foreign currency borrowers in society is ambiguous. Someone sympathizes with bank customers, and someone condemns them. Someone says that helping mortgage borrowers could lead to a renegotiation of the terms of conventional loan agreements. Such a policy would undermine the stability of the banking system and create prerequisites for the development of an economic crisis.

Currency mortgages constantly attract the attention of the press. They arrange pickets and hold various actions in public places. People storm bank offices and go on hunger strikes. Citizens are not satisfied with the actions of the authorities and financiers. The situation with foreign currency mortgages is a source of social tension. In 2017, a group of people seized the reception of the Bank of Russia and demanded a meeting with Elvira Nabiullina (head of the Central Bank of the Russian Federation). Preventive conversations were held with people. Unauthorized actions of the initiative group were suppressed by law enforcement agencies.

What is AHML

Making a mortgage for many Russians is the only way to buy personal residential property. At the same time, given the long-term nature of such a loan (more than ten years), a number of possible individual unforeseen circumstances, as well as the economic situation in the country, for some, making monthly payments to the bank becomes too heavy a financial burden. This, in turn, leads to the emergence of debt, and for it, according to the terms of the contract, penalties and fines are calculated.

In order not to lose housing, which the bank holds as a pledge and has the right to take away the money already paid on the mortgage for non-payment of the loan and not to spoil their credit history, citizens are forced to consider all possible exit options. For this reason, the state has developed and implemented a program to help borrowers who find themselves in a difficult situation through no fault of their own. This assistance is presented in the form of restructuring the mortgage agreement, that is, changing its conditions, and partial payment of the debt from the state budget. Reduce your monthly payment

One option for government assistance is to reduce the regular monthly contribution. However, it should be understood that this is done due to:

  • Extending the mortgage payment term, that is, the contract will be extended for several years;
  • Decreasing interest rates on loans. Thus, the amount of the monthly payment and the overpayment on the mortgage as a whole are reduced;

What does Sberbank offer?

Restructuring is executed at the initiative of the borrower, after the submission of the relevant application, documents and approval of such a request.


Conditions for participation:

  • The financial situation of the borrower during the last three months has deteriorated through no fault of his by thirty percent, in comparison with what he had when receiving a loan;
  • An increase in the monthly installment in rubles by more than thirty percent due to an increase in the exchange rate, if the loan is in foreign currency;
  • Net credit history.

At the same time, parents, adoptive parents and official guardians of children (up to eighteen years of age), large families, persons with disabilities and their parents who support disabled dependents, as well as war veterans are entitled to apply for assistance from the state.

Sberbank offers one of the following options as part of the loan restructuring:

  • A grace period of two years, in which the borrower is required to pay only interest every month;
  • Extension of the term of the loan agreement for a period of three to ten years;
  • Individual payment schedules (if the borrower, for example, has a seasonal job);
  • Quarterly payment of interest;
  • Loan holidays with changing interest rates.

Governmental support

Borrowers who find themselves in a difficult financial situation through no fault of their own can expect support from the state. It was for these purposes that AHML was created. The repayment of the mortgage and the restructuring itself works within the framework of a social program based on the government decree of the Russian Federation in 2015.

Mortgage programs today are diverse, but the state has focused on supporting people who have lost their solvency by thirty percent or more. Speaking about specific figures, the state can repay part of the mortgage in the amount of six hundred thousand rubles at a time. Thus, citizens have the opportunity to either lighten a little financial burdens, or pay off the balance of their debt and close the mortgage with these funds.

In 2015, the Government of the Russian Federation adopted a program to support mortgage borrowers who find themselves in a difficult life situation. This mortgage assistance program terminated ahead of schedule in March 2017 due to the expenditure of allocated funds.

In August 2017, the Government of the Russian Federation, headed by Medvedev D.A. allocated an additional 2 billion rubles to assist mortgage borrowers. However, the conditions of the program have changed significantly, and by 2018 the money allocated to help mortgage borrowers ran out again.

In order to further support mortgage lenders, the Government of the Russian Federation decided to provide additional funding for this program and, in accordance with Government Decree No. 1175 dated 03.10.2018 “On the Further Implementation of the Assistance Program for Certain Categories of Borrowers on Mortgage Loans (Loans) in a Difficult Financial Situation”, an additional amount of 731 million rubles was allocated.

For reference. The regulatory document regulating the procedure for providing assistance is Decree of the Government of the Russian Federation of April 20, 2015 N 373 (with amendments and additions in force in 2018) “On the main conditions for the implementation of the assistance program for certain categories of borrowers on mortgage loans (loans) who find themselves in a difficult financial situation, and an increase in the authorized capital of the joint-stock company Agency for Housing Mortgage Lending.

Now let's take a closer look at the new conditions for obtaining support for borrowers with a mortgage loan.

The DOM.RF joint-stock company (previously called the Agency for Housing Mortgage Lending) deals with issues of providing assistance in case of difficulties in paying off mortgage loans.

Assistance is provided in the form of loan restructuring. At the same time, restructuring can be carried out both by concluding an agreement by the creditor and the borrower (solid and several debtors) on changing the terms of a previously concluded loan agreement (loan agreement), and by entering into a new loan agreement (loan agreement) for the purpose of full repayment of the debt on the restructured housing mortgage loan. To conclude a debt restructuring, the borrower must submit an application to a credit institution.

The maximum reimbursement amount for a loan is 30% of the balance of the loan (loan) amount calculated as of the date of conclusion of the restructuring agreement, but not more than 1.5 million rubles.

At the same time, the interdepartmental commission for making decisions on compensation to creditors (lenders) on mortgage housing loans (loans), mortgage agents operating in accordance with the Federal Law "On Mortgage Securities", on mortgage housing credits (loans), the rights of claim on which acquired by mortgage agents, and to DOM.RF joint-stock company on mortgage housing loans (loans), the rights of claim on which were acquired by this company, losses (part thereof) resulting from the restructuring of mortgage housing loans (loans) in accordance with the terms of the program ( hereinafter referred to as the interdepartmental commission), the maximum amount of compensation for each restructured mortgage housing loan (loan), on the basis of the relevant application of the creditor to the interdepartmental commission, may be increased, but not more than 2 times, in the manner prescribed by the regulation on the interdepartmental commission.

Program duration

Decree of the Government of the Russian Federation of October 3, 2018 No. 1175 sets the deadline for submitting an application for assistance - December 01, 2018. Such applications may be considered later, and the actual assistance for such applications will be provided in the 1st quarter of 2019.

Important. An application for the need for restructuring in accordance with the assistance program must be submitted before December 01, 2018.

Conditions for providing support to mortgage borrowers

Now let's see who can get help. In accordance with the current legislation, citizens can count on assistance in case of mortgage difficulties subject to the following conditions simultaneously(listed below):

1 obligatory condition - categories of borrowers.

The borrower (solidary debtors) is a citizen of the Russian Federation belonging to one of the following categories:

  • citizens who have one or more minor children or who are guardians (custodians) of one or more minor children;
  • citizens who are disabled or have disabled children;
  • citizens who are combat veterans;
  • citizens who are dependent on persons under the age of 24 who are students, students (cadets), graduate students, adjuncts, residents, assistant trainees, interns and full-time students.

2nd condition - change in the financial position of the borrower (solid debtors).

To receive assistance, it is necessary that the average monthly total income of the borrower's family (solid and joint debtors), calculated for 3 months preceding the date of filing an application for restructuring, after deducting the amount of the planned monthly loan (loan) payment, calculated for the date preceding the date of filing an application for restructuring , does not exceed for each family member of the borrower (solidary debtor) twice the subsistence minimum established in the constituent entities of the Russian Federation, in whose territory the persons whose incomes were taken into account in the calculation live.

New condition. At the same time, the average monthly total income of the borrower's family (solid and joint debtors) in the billing period is equal to the sum of the average monthly incomes of the borrower (solid and joint debtors) and his family members and the amount of the scheduled monthly loan payment calculated on the date preceding the date of filing the restructuring application has increased by at least 30 percent compared to the amount of the scheduled monthly payment calculated as of the date of conclusion of the loan agreement (loan agreement).

In this way, despite the fact that the assistance program is designed not only for foreign currency borrowers, its condition of increasing the monthly payment by 30% suggests that this program will be available mainly to citizens who have taken a mortgage in foreign currency.

3 condition - the location of the property and the official registration of the mortgage.

4 condition - requirements for the area of ​​\u200b\u200bthe room.

Assistance is provided if the residential premises, including residential premises, the right to claim for which arises from the share agreement does not exceed:

  • 45 sq. meters - for a room with 1 living room;
  • 65 sq. meters - for a room with 2 living rooms;
  • 85 sq. meters - for a room with 3 or more living rooms /

5 condition - the only housing.

Assistance is provided only in the presence of a single housing. At the same time, it is allowed to have an aggregate share of the pledgor and members of his family in the right of ownership of no more than 1 other residential premises in the amount of no more than 50 percent.

Important. Compliance with these conditions is confirmed by the application of the borrower in a simple written form. The submission by the borrower of information from the Unified State Register of Real Estate is not required. Joint Stock Company "Agency for Housing Mortgage Lending" checks the information provided in accordance with this subparagraph by the borrower.

6 condition - the term of conclusion of the loan agreement.

Support is provided only for those loans for which the agreement was concluded at least 12 months before the date of submission by the borrower of the application for restructuring, except in cases where the mortgage loan (loan) is provided for the purpose of full repayment of the debt on the mortgage at least 12 months prior to the date of submission by the borrower of the application for restructuring.

New exceptions. Clause 9 of the new Program Terms (as amended by Decree of the Government of the Russian Federation of 11.08.2017 N 961) provides that in case of non-compliance with no more than two conditions provided for in clause 8 of this document, the payment of compensation under the program is allowed in accordance with the decision of the interdepartmental commission in the manner, provided by the regulation on the interdepartmental commission.

Form of support for mortgage borrowers

In order to receive assistance, the bank must provide for the following changes in the terms of the mortgage loan:

  1. change in the currency of the loan (loan) from foreign currency to Russian rubles at an exchange rate not exceeding the exchange rate of the corresponding currency established by the Central Bank of the Russian Federation as of the date of conclusion of the restructuring agreement (for credits (loans) denominated in foreign currency);
  2. setting the lending rate not higher than 11.5 percent per annum(for credits (loans) denominated in foreign currency) or not higher than the rate effective on the date of conclusion of the restructuring agreement (for credits (loans) denominated in Russian rubles);
  3. decrease in the borrower's financial obligations(solid debtors) in the amount not less than the maximum amount of compensation due to the one-time forgiveness of a part of the credit (loan) amount and (or) change of the credit (loan) currency from foreign currency to Russian rubles at a rate lower than the rate of the corresponding currency established by the Central Bank of the Russian Federation on the date of conclusion of the restructuring agreement (for credits (loans) nominated in foreign currency);
  4. exemption of the borrower (solidary debtors) from payment of a penalty accrued under the terms of the loan agreement (loan agreement), with the exception of the penalty actually paid by the borrower (solid and several debtors) and (or) collected on the basis of a court decision that has entered into legal force.

Which banks provide assistance to mortgage borrowers

Acceptance of documents to assist borrowers under the state program is carried out by the main banks of the Russian Federation. These include:

Sberbank, Gazprombank, VTB 24, Rosselkhozbank, Bank of Moscow, UniCredit Bank, Promsvyazbank, ROSBANK, BINBANK, Absolut Bank, Avtogradbank, AK BARS, AKIBANK, GLOBEXBANK, Far East Bank, Zapsibkombank, Bank ZENIT, Izhkombank, Krayinvestbank, Kurskprombank, LOKO-Bank , METKOMBANK, MTS-Bank, OTP Bank, Primsotsbank, RosEvroBank, Svyaz-Bank, Sobinbank, Center-invest.

Recall that in order to obtain restructuring, you must contact the bank that issued the mortgage loan, and then the bank itself applies to the Agency for Housing Mortgage Lending. Please note that the program does not provide for the complete exemption of the borrower from making monthly payments on the loan, from paying fines, penalties and penalties accrued under the terms of the loan agreement (loan agreement). The lender may consider the partial or full write-off of fines, penalties and forfeits for late payments formed during the period of deterioration of the borrower's solvency. However, according to the assistance program approved by the Government of the Russian Federation, he is not obliged to do this. In addition, the program does not provide for the borrower's release from property and title insurance obligations, as well as personal insurance, the conditions for which are specified in the current loan agreement.

To receive support, it is necessary to submit to the bank where the mortgage loan was received, applications with a list of documents provided by AHML JSC (DOM.RF).

Depending on the bank to which the application is submitted, the list of documents may vary slightly.

    AHML assistance to mortgage borrowers in 2017: a package of documents

    An increase in the level of problem debt on a mortgage loan, which was caused by a sudden depreciation of the Russian currency, led to the need for the State Duma of the Russian Federation to create special borrower support project. The bill currently in use was adopted in 2015 and operates through AHML.

    Conditions for granting economic assistance

    In order to acquire economic support, the borrower must meet a number of criteria:

  • Refers to groups of people who are affected by the project: people who have children under the age of majority, or children with disabilities, and in addition, those who participated in hostilities
  • Reducing the level of earnings by a third on any residential mortgage loan or a 30% increase in payments on a foreign currency mortgage loan. Accepted for comparison three-month periods, which preceded the moment of taking the loan (1st period) and the time of applying for restructuring (2nd relative period). To compare payments on a foreign currency mortgage, payments are taken into account at the time of applying for economic support and at the time of obtaining a loan, while both payments are converted into national currency at the Central Bank rate on the appropriate date for calculation. To provide support, information for the past three months on the amount of family earnings that falls on each family member is also taken into account, starting from the minimum income level in the region. If the amount of earnings will be more than twice the amount of the minimum income level then no help will be provided.
  • Getting a mortgage at least a year until the moment of applying for the acquisition of economic support. The currency of the loan does not matter.
  • Filing with an application and a certain package of papers to the bank where the loan was issued, despite the fact that the bank is obliged to participate in the project.

    Requirements apply to mortgaged residential property

    The property must meet a number of conditions:

  • The project covers all kinds of residential buildings purchased on a mortgage, objects for which the ownership right is extended under an agreement on equity participation in the construction.
  • Mortgage housing must have the status only one for the borrower of the dwelling. A situation is considered appropriate for this circumstance in which the person who has taken the loan has a common part in ownership of another dwelling, not exceeding fifty percent in any residential facility.
  • The price per square meter of a residential property that is under mortgage cannot exceed the price per square meter of a standard secondary or primary market apartment (it all depends on the proper status of the mortgaged dwelling) by more than 50%. The calculation takes into account the regional housing market and information about the cost according to Rosstat at the time of obtaining a mortgage loan.
  • To large families with 3 or more children conditions regarding the price and area of ​​the mortgaged dwelling do not apply.

    For the possibility of extracting economic support, the amount of debt on a mortgage loan and the facts of the borrower's participation in previous restructurings are not important.

    Where to go for financial support

    Despite the fact that the project is implemented through the EIRHS, and it also guarantees subsidies, interaction with the borrower takes place only through the lending bank.

    An application for obtaining financial support should be applied to the bank where the loan was received, or to the successor bank, which has received all the necessary rights of the lender.

    The latter is possible if, for example, the bank where the mortgage loan was received has lost its license, and its powers have been transferred to another bank. Participation of the borrowing bank in the project is considered an integral circumstance.

    Here it is important to take into account the fact that out of more than 500 operating banks, only 6 of all these institutions are considered to be project participants for this period.

    The program includes independent approval of terms and a certain package of securities for borrowers seeking to use state support for mortgage loans as a zone of responsibility of banks. Mandatory papers are considered an exception, the condition for the provision of which is noted at the legislative level.

    List of required documents

    Mandatory list of securities is intended to prove the borrower's authority to participate in the project, compliance with its conditions and obtaining economic support in a specific amount.

    Application form for loan restructuring

    The general set of papers includes:

  • Application, which has been prepared in accordance with a certain form. It is possible to take the application form and sample at the bank, but often it is also drawn up by the manager there.
  • Documents certifying the borrower's compliance with the group of persons with the possibility of receiving support (child's birth certificate, certificate of disability)
  • Papers that confirm the economic conditions for acquiring support: a copy of the work book, a certificate from the employer, an act of registration as unemployed, a document on earnings according to the information of the tax organization, FIU or social insurance, tax returns or all sorts of other papers that have every chance of formally proving the level of profit at the time of the loan, at the time of applying for restructuring, and generally witness a decrease in the level of profit by 30%.
  • Loan and collateral papers - a copy of the agreement, a certificate from the lender, a schedule according to which monthly payments are made, a collateral assessment report at the time of obtaining a loan, etc.

    Agreement for participation in shared construction

    Extracts from the state register of rights to real estate and papers, which are necessary to confirm the state of collateral, information about real estate, the absence or presence of other objects in the borrower's property, residential real estate, housing area and other information. Papers from the state register are required to affect absolutely all residential real estate objects staying with the borrower and his family members, and not just a mortgage loan. Statements are considered valid up to 3 months until the time they need to be submitted with the application for economic support, and if we talk about mortgage housing - a month.

    Description of the AHML program for assistance to mortgage borrowers, options for its application and the required package of documents

    In connection with a significant deterioration in the financial situation of citizens of the Russian Federation in 2015, the state decided to provide assistance to mortgage borrowers belonging to social groups. This project is implemented through the Agency for Housing Mortgage Lending (AHML). It is worth noting once that only certain citizens can use this assistance program, the requirements for which, as well as the necessary set of documents and the registration procedure, we will consider in more detail in this article.

    Options for helping mortgage borrowers

    It is important to note right away that at the moment the program applies exclusively to contracts concluded under it during the period until May 31, 2017. That is, if you can and want to use help, you should draw it up as soon as possible. We also recommend that you first check with your bank about his participation in the program and the availability of funds allocated by the budget for this assistance, since in their absence, all actions to collect documents and process them will be in vain.

    It should be understood that this program provides for several options for financial assistance, of which in the future the borrower himself with his bank chooses the most suitable one. Moreover, the procedure itself provides for the restructuring of a debt obligation through additional agreements or the conclusion of a new loan agreement. Direct assistance can be provided in one of four ways.

    1. Repayment of part of the principal debt on a mortgage. This option provides for a one-time transfer of funds, the amount of which cannot exceed 20% of the balance of the debt at the time of restructuring and 600,000 rubles (30% and 1,500,000 rubles for families with many children, and those with two minor children), with the intended purpose - reduction in the amount of principal debt.
    2. Decreased monthly payment. Its size will be reduced by at least 50% for up to 18 months.
    3. Interest rate cut. If the mortgage was originally issued in rubles, then the level of the newly established commission for the use of borrowed funds should not exceed its current value, and for loans in foreign currency - no more than 12% per annum.
    4. Change in lending currency. As assistance, it is envisaged to restructure debt from foreign currency into rubles at the exchange rate set by the Central Bank of the Russian Federation at the time of the transaction.

    It is worth noting that deferred payment is also available. That is, a grace period is provided for the repayment of the mortgage, which provides for the period of its validity, the release of the borrower from the obligation to pay part of the principal debt and accrued interest.

    Conditions for obtaining assistance to mortgage borrowers from AHML

    To use the program, a mortgage borrower, in addition to being a citizen of the Russian Federation, must meet all four basic requirements. If at least one of the conditions is not met, then, unfortunately, assistance will be denied.

    1. Relation to a social group. It will be enough to meet one of the following conditions:

    • Has one or more minor children (own, adopted or officially in care);
    • Combat veteran;
    • Himself is disabled or there is a disabled child in the family;
    • A dependent who is a student under the age of 24 is on provision.

    2. Lack of family income. If earlier (before 2017) a mandatory reduction in the borrower's salary by at least 30% was required, then at the moment this condition has been canceled. To meet this requirement, it is sufficient that the average family income for the last three months, after paying off the mortgage loan, does not exceed two living wages corresponding to the borrower's region of residence, for each member of his family.

    3. Compliance with living space. In addition to the mandatory use of an apartment, which in addition is located on the territory of the Russian Federation, as collateral for a mortgage loan, it is necessary that it:

    • According to the estimated cost, in the calculation of the price per 1 sq. meter, does not exceed 60% of the cost of 1 sq. meters of the relevant real estate according to the Federal State Statistics Service at the time of execution of the loan agreement;
    • The total living space did not exceed 45 sq. meters, if 1 room is indicated in its layout;
    • The total living space did not exceed 65 sq. meters, if its layout indicates 2 rooms;

    For the borrower, if you do not take into account the process of collecting the necessary package of documents, the process of using this program is quite simple.     The essence of the assistance program

    The assistance program has been running since 2015. However, there were so many people who wanted to solve their financial problems at the expense of the state that the budget funds allocated for the project ran out, and the project itself was curtailed.

    But at the end of the summer of 2017, the state decided to extend the program. On August 11, 2017, government decree No. 961 was issued on further measures to support mortgage lenders in a difficult financial situation. Some changes have been made to the existing program. From its content, it became clear that the state was completely oriented towards supporting the unlucky foreign exchange debtors.

    The new program has a number of features:

    1. Assistance to citizens with unsustainable mortgage debt is provided through its restructuring. This means that the loan is not “forgiven”, but the bank renews a new loan agreement with the client, with more favorable conditions for the borrower. Or draws up an additional agreement to the old one. The main purpose of the drawn up documents is to reduce the financial burden on the debtor, to make the loan agreement enforceable.
    2. No more than 30% of the mortgage debt is compensated at the state expense. At the same time, the maximum possible amount that can be allocated for partial repayment of the loan is 1.5 million rubles.
    3. The state warns that the assistance is provided one-time, and in further risky transactions with the bank, citizens will have to rely solely on themselves.

    When paying off part of the debt through the assistance program, the bank is obliged to restructure the loan on certain conditions:

    1. Re-register foreign currency loans in rubles - at the rate in force at the time of the conclusion of the renewed agreement;
    2. Set the interest rate for the borrower no more than 11.5% (annual);
    3. “Forgive” the client a certain amount of debt - at least 1.5 million rubles (due to partial write-off and / or recalculation at a more favorable exchange rate);

    On behalf of the state, assistance to mortgage borrowers is provided by AHML. This is the short name of the “Agency for Housing Mortgage Lending”, through which banks receive funds in the amounts of lost income from the client.     Pay attention: the maximum possible amount of compensation may be increased, but not more than twice its amount. The decision on this is made by a special interdepartmental commission - at the request of the debtor.

    Currently, the AHML official website contains information that mortgage debt restructuring is possible in 2 types:

    1. Reducing the interest rate;
    2. Recalculation in ruble equivalent at a lower rate.

    Who can count on support

    The government dictates tough conditions for those who are going to participate in it. The August government decree significantly reduced the list of citizens to whom the state is ready to cover part of the debt. For example, earlier it included employees of defense enterprises, municipal employees, and scientists. They are not on the new list.

    In 2018, the assistance program applies only to the following categories of borrowers:

    1. Adult citizens with disabilities;
    2. Parents raising children with disabilities;
    3. Veterans who participated in armed conflicts of recent decades (combat operations);
    4. Parents / guardians / guardians of minor children (in any number);
    5. Parents who provide financial support for their children, who study full-time in various educational institutions - until the “children” reach the age of 24.

    This list is closed, that is, exhaustive. However, strict requirements are imposed not only on debtors, but also on real estate, which is purchased with money borrowed from the bank.

    Real estate requirements

    The assistance program applies to certain residential properties.

    They must:

    1. be located in Russia;
    2. Be the only housing of the borrower and his household (it is allowed for them to have a share in another apartment/house/room, but not more than 50%);
    3. Do not exceed the established dimensions of the total area of ​​the room:
    • 85 m2 - for a 3-room (or more) residential facility;
    • 65 m2 - for a 2-room residential facility;
    • 45 m2 - if a property with 1 living room is taken in a mortgage.

    It is interesting that in the previous program, great attention was paid to the cost per square meter of housing purchased with a mortgage. It should not exceed the average market for the region by more than 60%. And the maximum footage was set not by the number of rooms, but by the number of members of the mortgagor's family living in a mortgage apartment. However, the updated assistance program from AHML does not contain these restrictions.

    Requirements for borrowers

    In order to participate in the program, borrowers must not only be included in the above list of “preferential” categories, but also meet very important additional criteria:

    1. 3 months before applying to the bank for mortgage debt restructuring, the average income of each member of the borrower's family, after paying the planned amount on the loan, did not exceed two subsistence levels established in their region of residence. Thus, the emphasis is on families with low and medium incomes, in which, despite the regularity of income, a mortgage loan has become an unbearable burden.
    2. At the time of filing an application for restructuring, regular loan payments must increase by at least 30% - compared to the amounts that were planned to be paid to the bank on the day the loan agreement was concluded. This condition cut off ruble-denominated mortgage lenders from the program, who may also be experiencing difficult financial problems. However, such a giant jump in monthly installments is likely only if the mortgage was taken in foreign currency.

    Required documents

    Wanting to receive assistance from the state, a citizen needs to contact the bank where the mortgage loan was issued. However, he will be required to collect a full package of documents, the same as when applying for a mortgage (read more about the necessary documents for applying for a mortgage loan).

    It will include:

    1. Photocopies of papers proving both the identity of the borrower himself and all his household members: Russian passports, "children's" certificates;
    2. Documents that confirm that he belongs to one of the categories of Russians who have the right to repay a mortgage with the help of the state:
      • certificates for children (if it is their presence that gives the right to state support);
      • veteran's certificate of the established form;

    3. Documents evidencing the amount of income of the borrower or solidary debtors, as well as the total income of his family members - for the last 3 months:
      • photocopies of the pages of the work book;

    4. A valid mortgage agreement concluded with the creditor bank (it must be executed at least a year before applying for debt restructuring);

    And even such a long list is likely to be incomplete, as different banks participating in the state mortgage subsidy program set their own list of required documentation. Usually it is posted on the electronic portals of credit organizations.

    Pay attention: an extract from the USRN on the ownership of the borrower (s) on the subject of collateral, that is, on real estate purchased on credit, banks no longer require applicants. Previously, they had to be taken, but now AHML itself requests this document from Rosreestr.

    Assistance Scheme

    So, a borrower experiencing difficulties in repaying a loan needs to contact the lender bank and find out if the lender is participating in this state program.

    If the answer is positive, the debtor will have to take a number of actions in order to receive assistance from AHML:

    1. You need to find out which department of the bank deals with this issue. Usually this is the department for dealing with debtors (or with overdue debts). By phone or through the website you need to find out his location and contact details.
    2. By calling the department or arriving in person, the borrower specifies what documents he will have to collect for submission to the bank.
    3. Having collected the necessary papers, the citizen sends them to the financial institution along with the application form. It states the reason why the borrower is applying for public assistance.
    4. Having received a package of papers from the debtor, the financial institution sends them to AHML for verification. It is believed that on average it lasts about a month. However, it is better to tune in to a longer wait, as many citizens complain that they had to wait for an answer for six months.
    5. Often, AHML requests additional documents, which the applicant is obliged to provide to him.
    6. If the Agency makes a positive decision, the bank informs the debtor about it and sets a meeting time to draw up a new loan agreement.
    7. At the meeting, either a completely new contract with modified conditions is drawn up, or an additional agreement is drawn up to the current document. An adjusted schedule of regular payments is also developed and signed, a paper is issued on changing the content of the mortgage.
    8. The previous mortgage is requested from the bank's archive. She has to wait 2-4 weeks.

    When collecting certain evidence (certificates from Rosreestr, copies of work books, etc.), these citizens apply to the credit institution that issued the mortgage loan with an application for restructuring under this program, the bank makes a decision, and after going through certain procedures (again, described by the program ), the principal debt is reduced by 20-30 percent (depending on the situation).     In general, from the first courses of legal education, one can recall that government acts reflect the administrative regulation of certain relations, respectively, it is not entirely correct to apply only civil legal norms to them (when protecting violated “civil” rights). However, to the surprise of the author, the courts (at the level of appellate instances) went to defend the banks refusing to issue such a “government restructuring”.

    In recent years, a crisis situation has been observed in the country. It led to a significant drop in incomes of the population. The state decided to provide assistance to certain categories of citizens who have taken loans in order to build new or purchase ready-made housing. The essence of the strategy is to support the settlement of debts to banking structures. This is done through the Agency for Housing Mortgage Lending (abbreviated as AHML).

    Initially, it was planned to complete this program by the end of 2016. Due to the impossibility of simultaneously satisfying all the requests of citizens, certain adjustments were made to the document. First, the date was set to March 1, 2018, and then to May 31. In August, new amendments were signed, within which no specific deadlines were specified.
